Do I need an LLC to buy a rental property in Connecticut?
There's no Connecticut law requiring it. Some investors hold rental property in an LLC for liability reasons, others hold it personally and rely on insurance, and the right call depends on your portfolio, your lender, and your goals. Will moving a mortgaged property into an LLC trigger my due-on-sale clause?
It can. A due-on-sale clause gives your lender the option to call the loan due in full when the property is transferred, and moving title into an LLC can count as a transfer depending on your loan documents. A federal law, the Garn-St Germain Act (12 U.S.C. §1701j-3), bars lenders from enforcing that clause on certain transfers of homes with fewer than five units: a transfer to a spouse or child, one that follows a divorce, or a move into a living trust where you stay a beneficiary, among others. A transfer into an LLC generally isn't on that list. Before you make that move, it's worth having your loan and your plan reviewed together.
What is a 1031 exchange, and how tight are the deadlines?
A 1031 exchange lets an investor defer capital gains tax by rolling a sale into a new investment property. The proceeds have to go through a qualified intermediary; if you take receipt of the money yourself, the deferral is generally lost. It also runs on strict, federally set deadlines for identifying and closing on the replacement property, and missing either deadline can mean losing the deferral entirely. What happens if a title issue turns up on an off-market deal?
The same process applies whether a deal came from the MLS or a handshake: your attorney orders and reviews the title search, and any liens, unreleased mortgages, or ownership gaps get flagged before closing. Clearing those issues is the seller's attorney's job: yours reviews the search and makes sure nothing gets missed.
Do I sign a deed when I refinance a rental to pull out cash for my next deal?
No. Ownership doesn't change in a refinance, so there's no deed involved. You sign a new mortgage and a new note. Connecticut's conveyance tax doesn't apply either, since that tax is tied to a transfer of ownership.
What does an investor closing cost?
Our attorney fee is a flat $1,050 for most residential closings, quoted in writing before we start. Title search, title insurance, and recording fees are third-party costs billed separately, at cost, so you can price a deal without guessing at the legal line.
